Report on Ordinance No. of 1904.
I have examined the accompanying Ordinance, entitled
An Ordinance to amend The Criminal Procedure Ordinance, 1893
and I am of opinion that the Ordinance is one which is not contrary to the Governor's Instructions.
The object of this Ordinance is to provide for the immediate discharge from custody of a person committed for trial in any case in which the Attorney General intimates that he does not intend to file an indictment against him.
A similar Ordinance is in operation in the Colony Fiji (No.9 of 1893).
